Hey guys,

Can you comment on recent information which has come to SAFWAA, that

it is now illegal to fish in the Torrens at the risk of a $70 fine?

If this is so, can you also comment on whether this bye law was passed

with any consultation with the community?, or maybe this is a

political issue and an un-fair question?

I haven't seen any signs or heard anything to that affect. That would be a very unpopular thing to happen.

Yeah, if this was indeed the case, this would be like West Lakes - where the Council have control of access to the lake and make by laws as to where you are allowed to fish.



I would have thought any information you received would have who it has come from and introduced this 'law'?

I do have a copy of the bye-law, I just wondered what the enforcement

Rediculous if true, but not surprising.
Some people think its their right to leave their shit where it falls expecting others to clean it up!
I've heard rumblings so dont be surprised if another Nthn council involved with a popular mud monster spot does a similar thing!

The foregoing by-law was duly made and passed at a meeting of the Corporation of the City of Adelaide held on the 10th day May 2004

2.19 Fauna

2.19.1 take, interfere with or disturb any animal, fish or bird or the eggs or young of any animal, fish or bird;
2.19.2 disturb, interfere with or damage any burrow, nest or habitat of any animal or bird;
2.19.3 use, possess or have control of any device for the purpose of killing or capturing any animal, fish or bird; or
2.19.4 release or abandon any animal, fish or bird;

Another quick search found this from Marion council

2.15 Flora and fauna
subject to the Native Vegetation Act 1991 and the National Parks and Wildlife Act
1972 –
2.15.1 damage, pick, or interfere with any plant or flower thereon; or
2.15.2 tease, or cause harm to any animal, bird or marine creature.
Not quite as specific but leaving a carp dead on the side of a bank while you carry on fishing should cover off..

To cut it short.. basically the council has the power to ask you to move on. They will send someone out to ask you to move on. This person will quote the by-law and if you don't move on they will call the police. I know this as I have been asked to move on from a spot before !

I haven't seen anything about a fine... If your asked to move on then move on apart from that ??? The council obviously has been turning a blind eye to the carp fishos otherwise someone would have been moved on by now. I'm sure in due time there will be written verification from the council to clarify the situation with people tryin to plan events. Can't see it being a fisheries issue though .

Hi,

As per above query, I was unaware that it was an offence to fish in the Torrens, but as per your postings, it appears that this is the case (as per Adelaide City Council bylaw).

Fisheries Officers don't have the authority to enforce Council legislation, therefore we have no involvement in this. We have enough to contend with regarding offences of Fisheries legislation!!!

For info, I am aware that there are many areas in West Lakes that also prohibit fishing from the shore (generally at the back of residences) by the public, which is also a local council bylaw.

Playford council is another which doesn't allow fishing in any creeks, rivers or dams within the area.
Fishing is a delusion entirely surrounded by liars in old clothes!

Another nail in the coffin of the (freshwater) Angler

I just dont get South Australian government and their policies

I've posted my thoughts and views on other topics, but unless we object against this on mass I can see it just being passed along to all the other local councils

Unfortunately "some" of these people in government departments see fishing as a cruel sport and put it into the same category as fox hunting and dog fights.

Maybe they should be invited to comment on here



I've got my idea of a private public access fishery being provisionally looked at by PIRSA next week

It might be the only place to fish soon and we'll be fishing like the japanese on their fisheries shoulder to shoulder

One thing I was thinking of the other day in regards to your scenario... isn't what you are asking for bsically the same as what Geoff has at spalding with a few extras thrown in ?? i know there are variations here and there but has he got writtne permission to charge people to catch and release ??
